Terms of service
These Terms of Service (the “Terms”) set out the conditions for using the online store “LM.RT” (the “Store”), operated by Ath0s Inc. (the “Company”). By using the Store, you are deemed to have agreed to these Terms.
Article 1 (Scope)
These Terms apply to all relations between the Company and the customer regarding use of the Store. The Customer Guide and the various policies separately published by the Company on the Store form part of these Terms.
Article 2 (Orders and Formation of the Contract)
A contract of sale is formed at the point when the customer places an order and the Company sends an order confirmation. We may be unable to accept an order due to stock availability or other circumstances; in such cases the Company will contact you.
Article 3 (Prices and Payment)
Prices are those displayed on each product page (inclusive of consumption tax). Payment may be made only by the methods designated by the Store (credit card, etc.).
Article 4 (Shipping)
Shipping is available within Japan only. For details of shipping fees and delivery times, please see the Shipping Policy and the Customer Guide.
Article 5 (Returns, Exchanges and Cancellations)
The conditions for returns, exchanges and cancellations are as set out in the Refund Policy.
Article 6 (Intellectual Property Rights)
Intellectual property rights in the product images, text, logos, designs and other content published on the Store belong to the Company or to the rightful owners. Reproduction, republication, modification or sale without the permission of the rights holder is not permitted.
Article 7 (Prohibited Conduct)
When using the Store, customers must not engage in any of the following:
- Acts that violate laws and regulations or public order and morals
- Purchasing items for the purpose of resale
- Placing orders using false information, or impersonating another person
- Acts that infringe the rights or interests of the Company or third parties
- Acts that interfere with the operation of the Store
If the Company determines that any of the above applies, it may cancel the order, suspend use of the Store, or take other measures.
Article 8 (Disclaimer)
The Company is not liable for damages arising from failures of communication lines or systems, natural disasters, or other causes not attributable to the Company. Except in cases of willful misconduct or gross negligence on the part of the Company, the Company’s liability for damages to the customer is limited to the purchase price of the item concerned.
Article 9 (Handling of Personal Information)
The Company handles customers’ personal information appropriately in accordance with “Handling of Personal Information” and the Privacy Policy.
Article 10 (Amendments to These Terms)
The Company may amend these Terms without prior notice to customers when it deems necessary. The amended Terms take effect from the time they are published on the Store.
Article 11 (Governing Law and Jurisdiction)
These Terms shall be interpreted in accordance with the laws of Japan. In the event of a dispute concerning the Store, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
